Property Compliance, Safety Laws & Regulations NSW SWIMMING POOL REGISTER

MANDATORY LAWS FOR BUYING, SELLING & LEASING

If you are buying, selling, or leasing a residential property in NSW with a swimming pool or swim spa, strict safety laws apply. A valid compliance certificate must be attached to the contract of sale before marketing the property.

  • Contract Requirements: Sellers must provide either a valid Certificate of Compliance or a Certificate of Non-Compliance. If purchasing a property with a non-compliance certificate, the buyer inherits the obligation to rectify the non-complying issue within 90 days of settlement.
  • Checklists & Registration: Every pool or spa pool must be registered on the official state database. Owners can use self-assessment checklists to evaluate fencing, gates, and warning signs.

To check a property's pool status, access safety checklists, or find a licensed private certifier, visit the official NSW Swimming Pool Register.

Missing or invalid compliance paperwork can jeopardise your sale.
Contact us to thoroughly discuss and review your contract compliance before proceeding with your sale or purchase.
